1. Acceptance of Terms

By accessing or using SiteData ("Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and SiteData ("we," "us," or "our"). Your continued use of the Service after any modification to these Terms constitutes your acceptance of the revised Terms.

2. Description of Service

SiteData provides a web-based platform for commercial and industrial real estate site selection intelligence. The Service aggregates, scores, and presents publicly available parcel data, demographic information, infrastructure proximity metrics, and economic incentive zone data for properties located in the state of Texas.

The Service is intended for professional use by site selectors, real estate developers, brokers, economic development organizations, and related professionals. Features include parcel search and filtering, composite site scoring, demographic and infrastructure analytics, and data export functionality. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

3. User Accounts

You must create an account to access the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account, whether or not authorized by you. You agree to notify us immediately of any unauthorized use of your account.

You agree to provide accurate, current, and complete information when creating your account and to update that information as necessary to keep it accurate and complete. You must be at least 18 years of age and have the full legal authority to enter into these Terms on behalf of yourself or any organization you represent. Accounts are non-transferable and may not be shared among multiple individuals without our written consent.

4. Subscription & Billing

The Service is offered on a subscription basis. Current plans include a Monthly plan at $50 per month and an Annual plan at $500 per year. All new subscriptions include a 5-day free trial period during which you will not be charged. At the end of the trial period, your selected subscription plan will begin and you will be billed accordingly.

Payment is processed through secure third-party payment processors. By providing payment information, you authorize us to charge the applicable fees to your payment method. Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.

Monthly subscribers may cancel at any time; cancellation takes effect at the end of the current billing period with no further charges. Annual subscribers may cancel before their renewal date; prorated refunds for unused time are available upon written request submitted within 30 days of the renewal charge. Prices are subject to change with 30 days' prior notice.

5. Data & Intellectual Property

The SiteData platform — including its proprietary scoring algorithms, interface design, compiled datasets, software, and all related content — is protected by copyright, trade secret, and other applicable intellectual property laws. All rights not expressly granted to you in these Terms are reserved by SiteData.

Underlying parcel and geospatial data is sourced from public agencies including the Texas Natural Resources Information System (TNRIS) / StratMap, the Texas Department of Transportation (TxDOT), the U.S. Census Bureau, the U.S. Department of Housing and Urban Development (HUD), and the Homeland Infrastructure Foundation-Level Data (HIFLD) program. Such data remains subject to those sources' respective terms and conditions.

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable license to access and use data through the Service for your own internal professional analysis and decision-making purposes. You may not resell, redistribute, sublicense, or otherwise make data obtained through the Service available to third parties without our prior written permission.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations;
  • Attempt to reverse-engineer, decompile, disassemble, scrape, or systematically extract data from the Service beyond the scope of your authorized access;
  • Share, sell, or transfer your account credentials to any other person or entity;
  • Use automated bots, crawlers, scrapers, or other tools to access the Service at a rate that materially degrades server performance or circumvents access controls;
  • Introduce malware, viruses, or other harmful code into the Service;
  • Use the Service to discriminate against any person in violation of applicable fair housing, civil rights, or anti-discrimination laws;
  • Misrepresent your identity or affiliation, or impersonate any person or organization;
  • Interfere with or disrupt the integrity or performance of the Service or related infrastructure.

We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this provision.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not warrant that data presented through the Service is complete, accurate, current, or suitable for any particular purpose. Parcel data, composite scores, proximity metrics, and analytics are provided for informational purposes only and do not constitute legal, financial, environmental, engineering, or investment advice.

Users should conduct their own independent due diligence — including consultation with qualified legal, financial, environmental, and real estate professionals — before making any site selection, development, or investment decisions based on information obtained through the Service.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LANDIQ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF THE SERVICE — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In all cases, our total cumulative liability to you for any claims arising out of or related to these Terms or the Service shall not exceed the total amount paid by you to SiteData in the twelve (12) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages; in such jurisdictions, our liability shall be limited to the maximum extent permitted by applicable law.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection, use, and disclosure of information as described in our Privacy Policy.

We do not sell your personal data to third parties. We may share data with trusted service providers who assist in operating the Service, subject to confidentiality obligations. We may also disclose data when required by law or to protect the rights, property, or safety of SiteData, our users, or others.

10. Termination

We may suspend or terminate your account and access to the Service at any time: (a) for violation of these Terms; (b) for non-payment of applicable fees; (c) if we reasonably believe your use poses a security or legal risk; or (d) for any reason with 30 days' prior written notice to you.

You may terminate your account at any time by contacting us or through your account settings. Upon termination for any reason, your right to access and use the Service immediately ceases. We are not liable for any loss or damage resulting from termination.

The following provisions survive termination of these Terms: Section 5 (Data & Intellectual Property), Section 7 (Disclaimers), Section 8 (Limitation of Liability), Section 11 (Governing Law), and any other provisions that by their nature should survive.

11. Governing Law

These Terms and any dispute arising out of or related to them or the Service shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

You agree that any legal action or proceeding relating to these Terms or your use of the Service shall be brought exclusively in the state or federal courts of competent jurisdiction located in Travis County, Texas. You hereby consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

If any provision of these Terms is found to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect. These Terms constitute the entire agreement between you and SiteData with respect to the Service.
